How to request public records and information from Mindoro State University under Executive Order No. 2, s. 2016.

Executive Order No. 2, s. 2016 puts into operation, in the Executive Branch, the people's constitutional right to information on matters of public concern (Article III, Section 7 of the 1987 Constitution) and the State policies of full public disclosure and transparency in the public service.

As a state university, Mindoro State University is covered by the Order. Every Filipino may request information, official records and public documents held by the University, subject to the exceptions provided by the Constitution, laws and jurisprudence.

How to Request Information

Online

Through the eFOI portal

Create an account on the government's electronic FOI portal, choose Mindoro State University and describe the information you need. You can follow your request there.

Standard request

Through the FOI Receiving Officer

Send or bring a written request to the University's FOI Receiving Officer by email, mail or in person.

What to include in your request

  • Your full name and contact information (address, email or mobile number)
  • A valid proof of identification, or proof of authorization if you are requesting for someone else
  • A clear description of the information you are requesting
  • The purpose of your request
  • How you would like to receive the information (for example, by email or a printed copy)

How a Request Is Processed

  1. Submit a written request

    File your request online through the eFOI portal, or send or bring a written request to the University's FOI Receiving Officer by email, mail or in person.

  2. Receipt and initial check

    The FOI Receiving Officer records your request, checks that it is complete and gives you a reference number you can use to follow up.

  3. Evaluation and decision

    The FOI Decision Maker locates the information and checks whether any exception or privacy protection applies, then grants the request in full or in part, or denies it.

  4. Release or notice of denial

    You receive the information in the format you asked for where reasonable. If the request is denied, you receive a written notice stating the grounds for the denial.

Fees

No fee is charged for accepting a request. The University may charge a reasonable fee to cover necessary costs, such as the actual cost of reproducing and copying the information, as provided in the MinSU People's FOI Manual (EO No. 2, Sec. 10).

Exceptions

Information that may not be released.

Access may be denied when the information falls under an exception in the Inventory of Exceptions issued by the Office of the President, which currently covers these categories. Personal information in government records is also protected under the Data Privacy Act of 2012 (Republic Act No. 10173) and Section 7 of EO No. 2.

  1. Information covered by executive privilege
  2. Privileged information relating to national security, defense or international relations
  3. Information concerning law enforcement and protection of public and personal safety
  4. Information deemed confidential for the protection of the privacy of persons and certain individuals such as minors, victims of crimes, or the accused
  5. Information, documents or records known by reason of official capacity and deemed confidential, including those submitted or disclosed by entities to government agencies
  6. Prejudicial premature disclosure
  7. Records of proceedings or information from proceedings which are confidential or privileged under law
  8. Matters considered confidential under banking and finance laws and their amendatory laws
  9. Other exceptions to the right to information under laws, jurisprudence and rules and regulations

If Your Request Is Denied

A denial may be appealed to the person or office next higher in authority. The written appeal must be filed by the person who made the request within fifteen (15) days from the notice of denial or from the lapse of the period to respond. The appeal is decided within thirty (30) working days from its filing. Failure to act on a request within the prescribed period is deemed a denial. After exhausting these administrative remedies, the requesting party may file the appropriate case in the proper courts (EO No. 2, Secs. 12 and 13).
